LAW (MONITORING CELL)

Background Overview

          The Public Accounts Committee in its 62nd Report(1991-93) has recommended that departments should have a feed back system in respect of their litigation and the Law Department should function as a nodal Department for monitoring and evaluating cases periodically with graphic details of each case.

Constitution  

          Monitoring Cell in the Law Department was consituted as per G.O (Rt) No.8440/97/GAD dated 16.10.1997. The Cell consists of a Joint Secretary, a Section Officer, two Legal Assistants, one Confidential Assistant and one peon under the administrative control of the Law Secretary.

Functions
          The main function of the Law(Monitoring Cell) Department is to conduct inspection in the Departments and Collectorates for the physical verification of pending files relating to Court cases to examine whether the cases are conducted properly, to report the lapses and shortcomings therein and to suggest the remedies thereof. As a preliminary step to inspection the Collectorates/Head of Departments/District Collectorates will be requested to furnish the list of all the pending court cases in their offices including the subordinate offices with details of present stage of each case in the prescribed proforma. After a thorough study of the list the date of inspection in each Head of Departments/Collectorates will be scheduled and the same will be communicated to the concerned

      A team of officers headed by the Joint Secretary will visit the Head of Departments/ Collectorates on the scheduled date for physical verification of files and Registers relating to court cases such as OS/OP/WP©/LAR/LAA/RR etc.

       Defects and lapses noticed in the conduct of cases including the maintenance of suit registers will be entered in the prescribed proforma and a detailed report with suggestions for rectifying those defects will be prepared by the cell and forwarded to the officers concerned for compliance. Copy of the report will also be forwarded to the Secretary to Government of the concerned Department for information and follow up action from that end.

      In the Collectorate the monitoring cell mainly concentrate on the verification of files relating to the RR and LAR as huge amount of revenue to Government is involved in these cases. 

Aims and Achievements
In the absence of a proper machinerry to monitor the conduct of court cases, most of the case files are left unattended causing accummulation of long pending files and huge loss to state exchequer.

    Ever since its constitution, the Law (MC) Department has been conducting inspections in all the Departments and collectorates after collecting the details of pending cases, to examine whether the cases are conducted properly, to report lapses and shortcomings therein and to suggest remedies thereof.

   Consequently there is considerable progress in the process of litigation activities. By  monitoring  the machinery through which the Departments/Collectorates  conducts cases before the courts, the Law(MC) Department is  implementing the spirit of the Public Accounts Committee.

Conclusion
The inspection by the Law (MC) Department is intended to verify and satisfy the machinery through which the cases are conducted before Special Courts, High Courts and other Courts, because the decisions on cases in which Government is a party are likely to make far reaching impacts on the society and Administrative machinery. So Government is bound to give more attention to the conduct of Government cases. Hence inspection of the conduct of cases before the courts by Law (MC) Department is of much relevance and importance.
