THE RIGHT TO INFORMATION ACT, 2005

               The Right to Information Act, 2005 (Central Act No.22 of 2005) is an Act to provide for setting out the practical regime of right to information for citizens to secure access to information under the control of public authorities in order to promote transparency and accountability in the working of every public authority, the constitution of a Central Information Commission and for State Information Commissions and for matters connected therewith or incidental thereto. The Act was assented to by the President of India on 15 th June, 2005. Section 3 of the Act provides that subject to the provisions of the Act, all citizens shall have the right to information. Section 4 details the obligations of public authorities and Section 5 provides for the designation of Public Information Officers.

            Pursuant to Circular No.80649/CDN 4/05/GAD, dated 15-10-2005 of General Administration (Co-ordination) Department, the Law Department has issued Order designating the State Public Information Officers, State Assistant Public Information Officer and the Appellate Authority vide G.O. (Rt) No. 810/05/Law, dated 19-10-2005.

ORDER

           Vide Government Order read above, the appellate authority, State Public Information Officers and State Assistant Public Information Officers of Law Department under the provisions of the Right to Information Act has been designated.

           In the Government Order read above, under the heading Public Information Officers, for the entires 1 and 2 the following shall be substituted namely: -

     "All the Additional Secretaries and Joint Secretaries".  In case where both the Additional Secretary and Joint secretary are in the same hierarchy the Additional Secretary concerned shall be the state Public Information Officer. Deputy Secretary shall be the State Public Information Officer in respect of Law (Monitoring Cell) Department.

The Government Order read above is modified to the above extent.

  The Government of India have enacted the Right to Information Act, 2005 to provide for setting out the practical regime of right to information for citizens to secure access to information under the control of Public Authorities in order to promote transparency and accountability in the working of any public authority. The General Administration (co-ordination) Department as per circular read above has requested to designate the State Public Information Officer, State Assistant Public Information Officer and Appellate Authority of this department.

     The Government have examined the matter in detail and are pleased to designate Public Information Officers and Assistant Public Information Officers as detailed below:-

  • All Additional Secretaries.
  • Joint Secretaries of Law in the case of Law (Inspection Wing) Department, Law (Monitoring) Department, Law (H) Department and Law (Publication) Department Joint Secretaries of Law (Suits) Department and the Competent Authority under the Notaries Act.

Assistant Public Information Officer

           The Deputy Secretary, Law (Parliamentary) Department.
